Why Hire a Workers’ Compensation Lawyer?

Workers’ compensation exists to let employees secure benefits after a workplace injury — and to prevent injured workers from suing their employers. Because the system is meant to protect workers, many people assume they don’t need a lawyer. In reality, the process can be confusing and frustrating, and not every claim is straightforward.

A workers’ compensation claim is not a lawsuit, so you need a lawyer who focuses specifically on workers’ compensation. Some employers contest whether the accident happened at work, or raise issues about pre-existing conditions. Insurance companies don’t like it when injured workers have experienced representation, because it’s bad for their bottom line — they put profits over people.

It is a proven fact that injured workers represented by experienced workers’ compensation lawyers receive significantly more in benefits and higher settlements than those who go it alone. Having an experienced advocate not only makes the claim process easier, it helps ensure you get the best treatment possible so you can recover faster.

Georgia Workers’ Compensation Benefits Explained

Georgia workers’ compensation law uses rigid guidelines to determine how much you are entitled to after a workplace injury or work-related death. The main categories of wage benefits are:

Temporary Total Disability (TTD)

Applies when your authorized treating physician says you can’t work at all — or clears you for light-duty work but your employer has none to offer. After a one-week waiting period, you’re entitled to weekly checks equal to two-thirds of your average weekly wage until you’re cleared to return to full-duty work or your employer provides suitable light-duty work.

Temporary Partial Disability (TPD)

Applies when your physician clears you to return to work in a light-duty capacity and you earn less as a result — due to reduced hours or a lower pay rate. If you qualify, weekly TPD checks equal two-thirds of the difference between your pre-injury and current pay.

Permanent Partial Disability (PPD)

Typically applies at the end of a claim when your physician says you’ve reached maximum medical improvement (MMI). Each affected body part is assigned a number of weeks of benefits and an impairment rating. An experienced lawyer is critical here to advocate for the highest possible rating. Weekly PPD benefits equal two-thirds of the average weekly wage.
